Employment Litigation & Dispute Resolution

As every employer knows, employment litigation and claims can have a significant impact on the workplace. Everything from employee’s morale to the company’s bottom line can be at stake. At Ferraiuoli, our team has the experience and track record to provide your business with first-class legal representation in a variety of forums in Puerto Rico and beyond. We partner with clients, acting as their consultants and litigants in employment and labor disputes. This combination produces highly effective results.

As an alternative to litigation and traditional adjudicative processes, we are at the forefront in adopting formal and informal mediation techniques to reach cost-effective, employment dispute resolutions. Our team has the formal education and experience to successfully mediate controversies arising in the workplace. We are proud of our long record of accomplishment in applying a mediation approach at the consulting stage and before or during litigation leading to satisfactory and successful settlements and practical solutions for our clients.

While we always strive to provide innovative solutions for workplace cases and controversies, when litigation is the right path, our team’s success in trial advocacy and motion practice bears witness to our effectiveness.

We litigate and handle employment disputes and defend management in state and federal courts and a variety of administrative forums, including the State Insurance Fund Corporation (local workers’ compensation agency), the U.S. Equal Employment Opportunity Commission (EEOC) and the U.S. Department of Labor and their local counterparts and subdivisions such as:

  • the Antidiscrimination Unit;
  • the Office of Mediation and Adjudication (known as OMA, for its Spanish acronym)
  • the Bureau of Employment Norms (wage and hour, unjust terminations, other employment disputes)
  • Unemployment Insurance Division, among others.

We are also able to assist clients with operations outside Puerto Rico for which we have partnered with state-side, outside counsel in litigations in California and Florida.
