IP Litigation

Our clients, locally and internationally, value and protect their intellectual property rights and trust our practical and efficient approach to resolving their intellectual property disputes, in Court and outside. When intellectual property matters become litigious, our Intellectual Property Litigation group has the experience and knowhow to represent clients in cases and matters before the appropriate tribunals — state and federal courts, the Patent Trial and Appeal Board, the Trademark Trial and Appeal Board, among others.

We represent our clients in enforcement actions and defend them against claims of infringement for all types of intellectual property including:

  • Trademarks
  • Copyrights
  • Patents
  • Trade secrets

Our Intellectual Property Litigation group has been the first and only law firm in Puerto Rico to participate as lead counsel in Markman hearings, one of the most crucial proceedings in a patent litigation case, not only in Puerto Rico, but also stateside.

Attorneys from our group have been lead counsel in patent infringement cases in the Eastern District of Texas, the District of Delaware, the Northern District of California, the Utah District Court, and the Circuit Court of Appeals for the Federal Circuit. Ferraiuoli has also been the only Puerto Rico law firm to appear in IPR proceedings before the Patent Trial and Appeals Board.

Our group also has ample experience in trademark and copyright litigation.  We were the first firm in Puerto Rico to litigate a case under the newly minted Puerto Rico Trade Secrets Act. Our litigators also excel in injunctive proceedings, before the local and federal courts.
