Mr. San Miguel joined Ferraiuoli as a Capital Member in March 2011. He is Chair of the firm’s Energy and Environmental Law Practice Groups. He is also a member of the Government and Legislative Affairs Practice Group.
Prior to joining Ferraiuoli, Mr. San Miguel was a partner in another major law firm in San Juan, specializing in environmental law and litigation, energy, land use matters and government/regulatory affairs. He represents businesses in all types of adversarial proceedings involving environmental issues, including administrative enforcement actions before the U.S. Environmental Protection Agency, the Puerto Rico Environmental Quality Board, the Puerto Rico Department of Natural and Environmental Resources, and the Puerto Rico Aqueduct and Sewer Authority, among others. He also counsels clients on regulatory compliance matters including Environmental Impact Statement processes, under applicable federal and local environmental statutes and regulations.
Mr. San Miguel is actively involved in energy law projects and has successfully represented clients before the P.R. Electric Power Authority negotiating power purchase and operation agreements related to renewable energy projects, including wind, solar and resource recovery facilities. He also represents clients in matters relating to the design, finance, build out and operation of alternative fuel facilities. During 2010, Mr. San Miguel served as a private sector member representative of the Puerto Rico Wheeling Committee, comprised of representatives from the P.R. Governor’s Office, P.R. Electric Power Authority, Department of Economic Development and Commerce, the Energy Affairs Administration and the P.R. Industrial Development Company.
During 2009, Mr. San Miguel helped lead a team that drafted Puerto Rico’s new Permits Process Reform Act Bill, under the stewardship of Puerto Rico’s Department of Economic Development and Commerce. The Bill became law on December 1, 2009, bringing significant changes to Puerto Rico’s permitting processes.
On the Government/Regulatory affairs front, Mr. San Miguel chaired and co-chaired the 2008 and 2012 Platform Committees for Governor Luis Fortuño, respectively. In addition, at the National level he served in the 2012 Republican Party Platform Committee under Committee Chairman, Governor Bob McDonnell (VA) and Co-Chairs Senator John Hoeven (R-ND) and Congressman Marsha Blackburn (R-TN). He was also a member of that platform’s subcommittee on Energy, Agriculture and the Environment. As a member of Ferraiuoli’s Government and Legislative Affairs Practice Group, he represents businesses in policymaking, permitting, regulatory, and economic development matters before the U.S. Congress, federal agencies, and the Executive and Legislative branches of both the State and Municipal governments.
